1. Acceptance of Terms

By accessing and using MCBANKS TRADES services, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

MCBANKS TRADES provides the following services:

• System & App Development
• Kenya Cyber Services (KRA, NTSA, eCitizen, etc.)

3. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information
• Make timely payments for services rendered
• Follow our guidelines and procedures
• Respect intellectual property rights
• Maintain confidentiality of shared information

4. Payment Terms

Payment terms vary by service type:

• Web development: 50% upfront, 50% upon completion
• Cyber services: Payment upon service completion
• Recruitment services: As per agreement terms
• Forex education: Payment before course commencement

All payments are non-refundable unless otherwise specified in writing.

5. Confidentiality

Both parties agree to maintain confidentiality of all proprietary information shared during the course of business. This includes but is not limited to business strategies, client data, and technical information.

6. Intellectual Property

All intellectual property rights, including copyrights, trademarks, and patents, remain with MCBANKS TRADES unless otherwise agreed in writing. Clients receive usage rights as specified in their service agreements.

7. Limitation of Liability

MCBANKS TRADES shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid for the specific service in question.

8. Service Availability

While we strive to maintain high service availability, we cannot guarantee 100% uptime. We reserve the right to suspend services for maintenance, upgrades, or other technical reasons.

3. Compliance with Laws

All services are provided in compliance with Kenyan laws and regulations. Clients are responsible for ensuring their use of our services complies with applicable laws in their jurisdiction.

10. Termination

Either party may terminate the service agreement with written notice. Termination does not relieve clients of payment obligations for services already rendered.

11. Dispute Resolution

Any disputes arising from these terms shall be resolved through negotiation in good faith. If unresolved, disputes shall be subject to Kenyan law and jurisdiction.

12. Amendments

MCBANKS TRADES reserves the right to amend these terms at any time. Clients will be notified of significant changes via email or through our website.
